Lenix SMS & Electronic Communications Terms

These SMS & Electronic Communications Terms (“Communications Terms”) govern electronic communications sent by or on behalf of Dig Dev LLC, doing business as Lenix Health (“Lenix,” “we,” “us,” or “our”) in connection with LenixHealth.com and the Lenix platform and services (collectively, the “Services”). These Communications Terms supplement the Lenix Terms of Use and Privacy Policy.
1. Electronic Communications
By providing an email address, mobile telephone number, or other electronic contact information to Lenix and using the Services, you acknowledge and agree that Lenix may communicate with you electronically regarding your account and use of the Services. Depending on your role and use of Lenix, communications may include:
- Account verification and authentication codes
- Login and security notifications
- Referral notifications
- Placement opportunities
- Provider responses
- Placement status updates
- Requests requiring user action
- Assessment or workflow notifications
- Account administration
- Service announcements
- Support communications
- Security or fraud-related notices
- Changes affecting the Services
- Other operational communications reasonably related to your use of Lenix
2. SMS/Text Messages
SMS consent is given only when you check the optional SMS consent box or reply START. SMS consent is not a condition of using the Services. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. OTP verification codes are sent on request for authentication and are separate from ongoing transactional messaging. You can change SMS preferences in your account settings. Transactional messages may include workflow alerts, action requests, status updates, and account activity. You represent that the mobile telephone number you provide belongs to you or that you are authorized to use that number.
3. Operational and Transactional Messages
Many Lenix communications are operational or transactional in nature. For example, Lenix may notify an authorized user that:
- An account requires verification
- A referral or placement opportunity requires attention
- Another authorized participant has responded
- A workflow has progressed to another stage
- Information or action is required
- A security event requires attention
These communications are intended to facilitate the Services and are not necessarily promotional or marketing communications. Where practical and appropriate, Lenix may direct users to sign in to the Lenix platform to review sensitive or detailed information rather than including that information directly in a text message or email.
4. Marketing Communications
Lenix may separately offer users the opportunity to receive promotional or marketing communications. Where consent is required by applicable law, Lenix will obtain the required consent before sending such communications. Consent to receive marketing communications is not a condition of purchasing or using Lenix Services, except where applicable law permits otherwise. Users may unsubscribe from marketing communications using the instructions included with those communications. Opting out of marketing communications does not necessarily prevent Lenix from sending operational, transactional, security, account, or legally required communications associated with continued use of the Services.
5. Opting Out of SMS
You may stop transactional SMS messages by replying STOP. Reply HELP for help. You may also change preferences in your account settings. SMS consent is optional and is not a condition of using the Services; dashboard and in-app notifications remain available when SMS is off.
6. Help
Where supported, you may reply HELP to a Lenix text message for information about the messaging program. You may also contact: legal@lenixhealth.com for questions regarding Lenix electronic communications.
7. Delivery Is Not Guaranteed
Electronic communications depend on telecommunications carriers, internet service providers, email providers, mobile devices, networks, and other systems outside Lenix's control. Lenix does not guarantee that any SMS message, email, notification, verification code, or other electronic communication will:
- Be delivered
- Be delivered immediately
- Be received in the order sent
- Be free from delay
- Be available without interruption
You are responsible for monitoring the Lenix platform as appropriate for your professional role and should not rely exclusively on SMS, email, or other external notifications to determine whether activity requiring your attention has occurred. Failure to receive a notification does not necessarily mean that the underlying activity, request, referral, placement event, or other action did not occur within Lenix.
8. Mobile Carriers
Wireless carriers are not responsible for delayed or undelivered messages. Availability of SMS functionality may depend on your carrier, device, location, telephone plan, and other factors outside Lenix's control. Standard message and data rates imposed by your carrier may apply. Lenix is not responsible for charges imposed by your telecommunications provider.
9. Security and Confidentiality
SMS and ordinary email may not provide the same security protections as authenticated access to the Lenix platform. For this reason, Lenix may limit the information contained in external notifications and instead direct authorized users to access information through Lenix. Users should not forward, copy, disclose, or otherwise distribute restricted Lenix communications to unauthorized individuals. Users are responsible for maintaining reasonable control over devices, email accounts, mobile telephone numbers, and other communication methods associated with their Lenix account.
10. Changed or Reassigned Telephone Numbers
You agree to notify Lenix or update your account information if you discontinue use of a mobile telephone number associated with your Lenix account. You should remove or update a telephone number before it is reassigned to another person whenever reasonably possible. Lenix may suspend messaging or account functionality associated with a telephone number if we believe the number has been reassigned, disconnected, compromised, or is otherwise no longer appropriate for use with the account.
11. Communications From Authorized Lenix Systems and Providers
Lenix may use third-party communications providers, telecommunications carriers, email providers, and other service providers to deliver electronic communications. Your consent to receive communications from Lenix includes communications transmitted on Lenix's behalf through such service providers as reasonably necessary to provide the Services.
12. Changes to Communications Services
Lenix may modify, suspend, replace, or discontinue particular communication methods or providers at any time. Lenix may also change the types of operational notifications provided as the Services evolve. Users remain responsible for maintaining current contact information and monitoring their Lenix accounts as appropriate.
13. Electronic Notices and Records
To the extent permitted by applicable law, you consent to receive notices, disclosures, agreements, confirmations, and other records from Lenix electronically. Electronic communications may satisfy legal requirements that communications be provided in writing where permitted by applicable law. You are responsible for maintaining equipment and software reasonably necessary to access electronic communications and for maintaining current contact information.
14. No Emergency Communications
Lenix communications are not an emergency notification service. Do not use Lenix SMS, email, or platform notifications to request or provide emergency medical assistance. If emergency assistance is required, contact the appropriate emergency services or healthcare professionals directly.
15. Relationship to Other Lenix Agreements
These Communications Terms supplement the Lenix Terms of Use and Privacy Policy. Additional agreements may apply to hospitals, healthcare organizations, providers, facilities, or other organizations using Lenix. If a separate written agreement between Lenix and an organization contains specific electronic communication requirements, that agreement may control to the extent of a conflict.
16. Changes to These Communications Terms
Lenix may update these Communications Terms as our Services, communication technologies, business practices, or legal requirements change. We will update the Last Updated date when changes are made. Where required by applicable law, Lenix may provide additional notice or obtain additional consent.
